Who is Eligible for Expungement?

Generally, there are two situations you may be eligible for expungement following an arrest - if your criminal charges are ultimately dismissed or if your charges result in a disposition of court supervision. If your criminal charges are dismissed, you are immediately eligible for expungement.

If you receive a disposition of court supervision, you will have to wait a set period of time for expungement, if this remedy is available at all. For some crimes you must wait two years from the termination of supervision, others require a five year waiting period and some are not eligible for expungement at all.

The Illinois state legislature is constantly adjusting the statute related to expungement, increasing or decreasing the waiting period to expunge any particular charges.
