There is a proliferation of law enforcement activity in computer child porn cases. Some of the arrests in this area are problematic. For example, most of these cases involve the execution of search warrants and the validity of these warrants may be in issue. If the warrants are invalid, then the search for the computer or the search of the computer's hard drive would be invalid. Second, there may be issues involving the computer owner's actual knowledge of depictions on the hard drive. Third, there may be instances where the computer owner may be the victim of hacking. The foregoing are just several viable defenses to this very serious offense. Like all cases, ascertaining effective defenses requires a lawyer who is experienced in the field and who is willing to expend the time and energy necessary.
